U.S. Court of Appeals Case No: 99-3182
and No: 00-1596
and No: 99-3330
District of Minnesota
Criminal case - criminal law. Evidence was sufficient to support
drug trafficking conspiracy conviction; court did not abuse its
discretion in denying continuance of indefinite duration to secure
defense witness whose testimony would have been excluded as
relating to a collateral matter; no error in permitting witness to
decode audio tapes for jury; no Apprendi violation as supervised
release period did not exceed maximum provided in 21 U.S.C.
Sec. 841(b)(1)(C); court properly calculated amount of drugs
involved; if the criminal activity involved five or more people,
a defendant can not receive a two-level adjustment and the district
court did not err in rejecting defendant's request for such a
compromise adjustment.
