U.S. Court of Appeals Case No: 99-3585
Southern District of Iowa
Criminal case. Following guilty plea to possessing cocaine base
with intent to distribute, defendant appeals sentence of 110 months
imprisonment. District court's rejection of sentence entrapment claim
is remanded for district court to reconsider claim and focus on the
defendant's predisposition rather than on whether the government's
conduct was outrageous. District court did not clearly err in granting
a two-level, rather than a three-level, reduction for acceptance of
responsibility.
