U.S. Court of Appeals Case No: 99-3593
District of Nebraska
Civil case - torts. Defendants had sufficient contacts with
Nebraska to create personal jurisdiction; existence of a
contract between plaintiff and defendants' company did not
bar plaintiff from suing defendants in tort as plaintiff was
not seeking damages or other remedies for breach of contract
but was, instead, seeking recovery for fraud, conversion or
negligent misrepresentations based on defendants' statements
concerning return of anti-dumping customs duties; evidence
was sufficient to support jury verdicts for plaintiff; claim
instructions were erroneous rejected.
