Civil case - civil rights. District court's refusal to accept a Federal Tort
Claims Act certification is the equivalent of the denial of a motion
for qualified immunity and is immediately appealable; Federal Tort
Claims Act claims against postal supervisor cannot be maintained
because they are preempted by plaintiff's Title VII claims against the
Postal Service; when the same set of facts supports a Title VII claim
and a state law non-Title VII claim against a federal employer, Title VII
preempts the state law non-Title VII claim, and the state law claims
against plaintiff's supervisor must be dismissed.
