Civil case - Environmental law. By entering into the Central Interstate
Low-Level Radioactive Waste Compact, Nebraska waived its
Eleventh Amendment immunity to suit by the Waste Commission;
Compact permitted the relief sought by the Commission, and
Commission could state a claim for damages; nuclear waste
generators and applicant for license to build facility did not have
federal statutory right to good faith dealing under the Compact and
state officials were entitled to qualified immunity with respect to
those claims; matter remanded for further consideration of the
generators' and applicant's claims for violation of their substantive
and procedural due process rights.
