Civil case - civil rights. ATF agent was entitled to qualified
immunity on claim he had intentionally or recklessly made
misstatements or omissions in the affidavit used to obtain a
search warrant for plaintiff's explosives plant; agent was entitled
to qualified immunity on malicious prosecution claim because
plaintiff failed to allege agent infringed a constitutional right;
agent's actions did not violated plaintiff's First Amendment rights
as plaintiff failed to show his actions were in retaliation for their
assertions that they were the victims of over-regulation.
