U.S. Court of Appeals Case No: 95-1886
and No: 95-1944
Eastern District of Arkansas
Labor law - There was no evidence carpenters' union participated in
convincing company to break its contract with plaintiffs and other
union, which was present and did speak against plaintiffs was not
carpenters' agent; state law claim for tortious interference with
contract was preempted by federal law; on claim that statements by
union were an illegal secondary boycott, district court erred in
admitting a tape concerning a riot in Minnesota since the tape was
prejudicial and misleading; this claim remanded for a new trial.
